Please carefully read these Terms and Conditions (“Terms”) which apply to the use of the systems, applications, and services managed and maintained by the North Dakota Board of Nursing (“NDBON”) (the “Systems”). The Terms constitute a contract and include contractual restrictions on your rights to access and use the Systems. By accessing and/or using the Systems, you signify your understanding and agreement to these Terms, and that you will be bound by them. If you do not agree to these Terms, you may not and please do not access or use the Systems.

The Systems provide information and applications relating to nurse license management. The Systems are provided to state Boards of Nursing by NDBON. By accessing the Systems, you are granted a limited, non-exclusive and non-transferable license to access the Systems for personal and non-commercial purposes of license management. This license does not permit, or include the right to, any reproduction, reuse, transmission, sale or other commercial or derivative use of any data in the Systems. You are prohibited from any downloading or copying of any data for any third party’s use or from accessing the Systems using any data mining or automated data gathering or extraction tools.

NDBON may block, suspend, alter or terminate, temporarily or permanently, your access to, or use of, the Systems, for any reason, without cause, including because your access or use violates these Terms or compromises or impedes any of system functionality, or for any other reason.

These Terms may be modified, improved and/or changed at any time. Any changes will be incorporated into these Terms and posted from time to time, and your continued access and/or use of the Systems following the posting of any changes to these Terms will be deemed your agreement and acceptance of such changes.

If these Terms or Systems access are terminated, the obligations and liabilities you incur prior to the termination date shall survive the termination for all purposes. In the event of any such termination, the restrictions on your use of the material provided through the Systems shall survive such termination, and you agree to be bound by those terms.

You acknowledge and agree that neither NDBON nor any of its agents, employees, volunteers, third-party providers, or other parties associated with the provision or maintenance of the systems shall be liable to you or to any third party for any modification, suspension, or discontinuance of the systems or any services or information provided through or accessed by you through the systems, and you hereby release them from all liability and waive all claims of any sort (including all torts) against them which may arise from, in relation to, or by your use of the systems.
